Snackette owner charges contempt of Court over demolition

THE owner of an East Bank Demerara snackette that was demolished has moved to Court over the demolition.Anil Singh Mohanlall has cited Rickford Lowe, Coordinator of the Work Services Group in the Ministry of Public Works and Communication and John Hicks for contempt of Court.Mohanlall said his stall was destroyed despite Justice Jainarayan Singh granting prerogative remedies on October 4, 2007.At the hearing in the High Court, last Thursday, he said the judge had directed that the authorities show cause why the decision to demolish his place should not be quashedAccording to him, the important aspects of the edict were to prohibit Minister Robeson Benn and Lowe from taking action on their September7, 2007 decision in respect of the premises situated on the eastern parapet, at the junction of the Soesdyke/Linden Highway and Soesdyke Public Road.He said the judge had issued the injunctive on the ground that to remove and or break down the structure was unreasonable, arbitrary, unlawful, in excess of jurisdiction, null, void and without legal effect.The witness told Justice Singh the respondents well knew that before they acted, they had to get his orders discharged.But Lowe and Hicks, in flagrant breach of the ruling, caused and or instructed several employees and servants, chief of whom was Hicks, to completely tear down the building, Mohanlall testified.Consequently, Mohanlall is requesting that they be jailed for contempt of Court.Attorney-at-law Mr. Khemraj Ramjattan is appearing for Mohanlall while the Attorney General, Mr. Doodnauth Singh, S.C., is representing the respondents in the case which continues on July 7.
