Dataram has not breached judge’s order

I refer to your report of Thursday January 24, 2008, at page nine caption, “Police issue wanted bulletin for Dataram.”

Please be advised that Mr. Dataram has not breached the Order of His Honour Mr. Justice Jainarayan Singh. The Commissioner of Police should read and understand the Order made by the Court. The Order states that “Mr. Barry Dataram report to a Police Station on Mondays and Fridays of each and every week as directed by the Commissioner of the Police”.

Mr. Dataram cannot be held accountable for any break down of communication between his ranks and himself. Further the Commissioner of Police being a person admitted to practice Law should advise himself as to what constitutes a recognisance and what constitutes a breach of a recognisance. For his easy reference I wish to refer him to Section 21 of the Police Act (Chapter 16:01).

May I take this opportunity to call upon the Guyana Bar Association and those who have taken silk to respond to the letter of Ms. Shalimar Ali Hack, Director of Public Prosecutions (AG).
