Prosecution closes with cause of death still disputed
THE Prosecution at the preliminary inquiry (PI) in the Farouk Razac murder case closed yesterday, with the Defence still disputing the cause of death.
Arguments on that issue engaged Magistrate Gordon Gilhuys, with accused beauty queen, 33-year-old Carol Ann Lynch in the dock, charged for the unlawful killing of her Swiss House cambio boss husband.
The victim was pronounced dead after being found in his Lot 107 Ireng Place, Bel Air Park, Georgetown home, last May 7.
Special Prosecutor Hukumchand announced the closure of his case after Melissa Watson, who is a niece of Lynch, gave her evidence and Defence Counsel Nigel Hughes declined cross-examination of the witness.
Hughes submitted that the cause of Razac’s demise is still uncertain, because Dr. Nehaul Singh stated that the findings in his post mortem report were subject to a toxicology test which has not been done despite body parts being removed specifically for such a purpose.
Hughes also contended that there has been no explanation, from the Prosecution, why the result of such testing is not available to the Court.
Defence Counsel noted that, from the commencement of the pre-trial proceedings, the accused has been requesting medical reports and seeking an opportunity for experts of her choice to advise on them.
Hughes said, now that that the Prosecutor has ended his presentation, the cause of Razac’s death, which is a burning issue, has not been revealed.
According to Hughes, if the Court experts are unaware of how the victim died, the consequence would be speculation and the magistrate should discharge the prisoner.
Hukumchand responded that there is sufficient evidence on record for Lynch to be called upon for a defence.
He said, from the outset, the Prosecution posited that it is a case of circumstantial evidence.
Hukumchand said, though lacking eyewitnesses, the testimony would lead to the inescapable inference that the person charged with the crime is the one who committed it.
He said the crucial question, at this stage, has to do with where Lynch was at the time of Razac’s death.
Hukumchand said, since Razac died early that morning, Lynch, being his wife, was the only person with him.
Magistrate Gilhuys adjourned the case to Monday, when he would rule on the no-case submission. (Telesha Persaud)
